Terms of Service

Here is the short version. The full terms below are what legally applies.

These Terms of Service ("Terms") form a binding legal agreement between you ("you" or "User") and KairoX ("KairoX," "we," "us," or "our"), the operator of FaithLinked (the "App" or "Service"). By creating an account, tapping "Begin Your Story," or otherwise accessing or using the Service in any way, from any country or jurisdiction, you irrevocably agree to be bound by these Terms and by our Privacy Policy, Community Guidelines, and Safety Guidelines, each of which is incorporated by reference. If you do not agree, you must immediately cease all use of the Service.

These Terms apply globally to all users, regardless of where you are located.

1. Eligibility

You must be at least 18 years old to create an account or use FaithLinked. By using the Service you represent and warrant that: (a) you are 18 years of age or older; (b) you have the full legal capacity to enter into a binding contract in your jurisdiction; (c) your use of the Service is lawful under the laws of your jurisdiction and you are not prohibited from receiving or using the Service; (d) you have never been convicted of, or pleaded guilty or no contest to, a felony, a sex crime, or any crime involving violence, dishonesty, or moral turpitude, and you are not required to register as a sex offender in any jurisdiction; (e) you will only maintain one active account; and (f) all registration information you submit is and will remain truthful, accurate, and current. We reserve the right, in our sole and absolute discretion, to require proof of age or identity at any time and to immediately and permanently terminate any account we suspect or believe belongs to someone under 18 or who has made any false representation, without notice and without refund.

2. The Service

FaithLinked is a faith-based social and dating application that allows eligible users to create a profile, browse and match with other users, exchange messages, and participate in community features. We operate the Service globally and make no representation that it is appropriate or lawful in any particular jurisdiction. If you access the Service from a location where its content or use is prohibited or restricted, you do so at your own risk and are solely responsible for compliance with all applicable local laws. Some features (including browsing, matching, and chat) require an active FaithLinked Premium subscription, sold through the Apple App Store or Google Play. We may add, modify, restrict, suspend, or permanently discontinue any feature, including Premium features and pricing, at any time, with or without notice, and without any liability to you whatsoever.

3. Your Account

You are solely and exclusively responsible for all activity that occurs under your account, whether or not authorized by you. You must keep your login credentials strictly confidential. You agree to notify us immediately at kairoxsolutions@gmail.com upon becoming aware of any unauthorized access to or use of your account. We are not liable for any loss, damage, or harm arising from your failure to safeguard your account. You may not sell, transfer, license, sublicense, or otherwise share your account with any other person. Each account is personal and non-transferable.

4. Acceptable Use

You agree that you will NOT, and will not attempt to, directly or indirectly: (a) misrepresent your identity, age, location, marital status, faith, or affiliation with any person or entity; (b) create a profile for anyone other than yourself; (c) harass, stalk, threaten, defame, bully, intimidate, extort, abuse, or otherwise harm any user or third party; (d) post, transmit, upload, or solicit any content that is unlawful, obscene, pornographic, explicit, hateful, discriminatory, racially offensive, violent, deceptive, or that infringes any third-party intellectual property or other rights; (e) solicit money, gifts, cryptocurrency, loans, or financial information from other users (romance scams and similar conduct result in immediate permanent ban and may be reported to law enforcement); (f) use the Service for any commercial solicitation, multi-level marketing, advertising, spam, or affiliate promotion without our prior written consent; (g) upload photos that are not genuine, current, unaltered photos of yourself, or that depict minors, nudity, or sexually explicit content; (h) use automated tools, bots, scrapers, or AI agents to access, scrape, or interact with the Service; (i) reverse-engineer, decompile, disassemble, or attempt to extract the source code, algorithms, or models of the App; (j) create multiple accounts, or create a new account after we have banned or suspended any prior account; (k) circumvent, disable, or interfere with any security, access-control, moderation, verification, or rate-limiting feature of the Service; (l) interfere with or disrupt the integrity or performance of the Service or its infrastructure; or (m) violate any applicable local, national, or international law or regulation. Violation of this Section is grounds for immediate suspension or permanent termination of your account, in our sole and absolute discretion, without notice, without explanation, and without refund. We may also pursue any available legal remedies.

5. User Content and Licence Grant

You retain ownership of the photos, messages, profile information, and other content you submit to the Service ("User Content"). By submitting any User Content, you grant KairoX a worldwide, irrevocable, perpetual, non-exclusive, royalty-free, fully paid-up, sublicensable, and transferable licence to host, store, cache, use, copy, display, reproduce, adapt, edit, translate, publish, distribute, aggregate, and create derivative works from such User Content, in any media or format now known or later developed, in connection with operating, promoting, marketing, moderating, training, improving, and extending the Service and KairoX's business, without any obligation to compensate you. You waive any moral rights in your User Content to the fullest extent permitted by law. You represent and warrant that you own or have all necessary rights to your User Content and that it does not violate any third-party rights or any applicable law. We may, but are not obligated to, review, screen, moderate, edit, refuse, or remove any User Content at any time, for any reason or no reason, without notice and without liability.

6. Photo Verification and Biometric Data

To help keep the community authentic, FaithLinked uses on-device facial detection technology to verify that uploaded photos depict a real, live human face and may derive mathematical representations of facial geometry ("face vectors") to support re-verification and to detect fraudulent, impersonated, or duplicate accounts. By uploading a photo or using any verification feature, you expressly consent to this processing globally. Face vectors are used solely for verification, fraud prevention, and safety purposes; are stored securely; are never sold; and are deleted when you delete your account or upon a verified deletion request. If you do not consent, do not upload photos — but note that most Service features will be unavailable without a verified photo.

7. No Guarantee of Matches, Compatibility, or Safety

FaithLinked provides a platform only. We make no guarantee, representation, or warranty that you will find a match, form a relationship, or have any particular experience on the Service. We do not and cannot verify the identity, background, location, intentions, faith, marital status, or truthfulness of any user. We do not conduct background checks or sex-offender registry checks. You are solely and entirely responsible for evaluating any person you communicate or meet with through the Service. Any interaction — online or in person — is at your own risk.

8. Assumption of Risk; Global Release

YOUR INTERACTIONS WITH OTHER USERS, INCLUDING ANY IN-PERSON MEETINGS ARRANGED THROUGH OR FACILITATED BY THE SERVICE, ARE SOLELY BETWEEN YOU AND THAT USER AND ARE ENTIRELY AT YOUR OWN RISK. TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW IN YOUR JURISDICTION, YOU IRREVOCABLY RELEASE KAIROX, ITS PARENT, AFFILIATES, OFFICERS, DIRECTORS, EMPLOYEES, AGENTS, LICENSORS, AND SUPPLIERS FROM ANY AND ALL CLAIMS, DEMANDS, LOSSES, LIABILITIES, DAMAGES, COSTS, AND EXPENSES OF ANY NATURE OR KIND, INCLUDING PERSONAL INJURY, DEATH, EMOTIONAL DISTRESS, AND PROPERTY DAMAGE, ARISING OUT OF OR IN ANY WAY CONNECTED WITH YOUR USE OF THE SERVICE OR YOUR INTERACTION WITH ANY OTHER USER, WHETHER ONLINE OR OFFLINE, WHETHER KNOWN OR UNKNOWN, WHETHER ANTICIPATED OR UNANTICIPATED. THIS RELEASE IS INTENDED TO APPLY TO THE FULLEST EXTENT PERMITTED BY THE LAW OF EACH JURISDICTION IN WHICH IT IS INVOKED, AND A SUBSTANTIALLY EQUIVALENT WAIVER APPLIES IN EACH SUCH JURISDICTION TO THE MAXIMUM EXTENT ALLOWED.

9. Reporting, Blocking, and Moderation

We provide in-app tools to report and block other users. We may, in our sole and absolute discretion and without any obligation, warn, restrict, suspend, shadow-ban, or permanently ban any account, including immediately and without prior notice, for any reason or no reason, including conduct we believe violates these Terms, our Community Guidelines, or our Safety Guidelines, or that we believe is harmful, disruptive, or inconsistent with the spirit of the Service. We have no obligation to take any particular action in response to any report, to disclose any moderation decision or its outcome, or to provide any reason for any action taken. Moderation decisions are final.

10. Subscriptions, Payments, and Donations

Certain features require a paid FaithLinked Premium subscription, billed through the Apple App Store or Google Play in accordance with their respective payment terms. Subscriptions automatically renew at the end of each billing period unless cancelled at least 24 hours before renewal through your app-store account settings. All fees are non-refundable to the fullest extent permitted by applicable law. We do not process refunds directly; refund eligibility, if any, is solely determined by the applicable app store. We may change subscription pricing, features, or billing cycles at any time, with or without notice. Introductory offers, trials, and promotional pricing are offered at our sole discretion and may be modified, revoked, or discontinued at any time. Donations made through the Service are voluntary, non-refundable, and do not entitle the donor to any goods, services, equity, or preferential treatment.

11. Termination

You may stop using the Service or delete your account at any time through Settings. We may suspend, restrict, or permanently terminate your account or your access to all or any part of the Service, at any time, with or without cause, with or without notice, and without any liability to you. Upon termination for any reason, your right to access and use the Service immediately and irrevocably ceases. Sections 5, 6 (as to already-processed data), 8, 12 through 17, and 19 of these Terms survive any termination or expiry.

12. Intellectual Property

The Service and all of its content, features, software, design, text, graphics, logos, icons, and the "FaithLinked" and "KairoX" names and marks are owned exclusively by KairoX or its licensors and are protected by copyright, trademark, trade secret, and other applicable intellectual property laws worldwide. No right, title, or interest in the Service is transferred to you. You may not copy, modify, distribute, sell, lease, publicly display, create derivative works from, or commercially exploit any part of the Service without our prior express written consent.

13. Third-Party Services

The Service relies on third-party providers including Supabase (backend and database), Google/Firebase (push notifications, sign-in, and analytics), and RevenueCat and the applicable app stores (subscription billing). We are not responsible for the acts, omissions, downtime, data practices, or policies of these third parties, and your use of any third-party service is governed solely by that provider's own terms and policies.

14. Disclaimer of Warranties

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE," WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, STATUTORY, OR OTHERWISE, INCLUDING WITHOUT LIMITATION ANY IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, ACCURACY, RELIABILITY, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, SECURE, ERROR-FREE, VIRUS-FREE, OR FREE OF HARMFUL COMPONENTS, OR THAT ANY DEFECTS WILL BE CORRECTED, OR THAT THE SERVICE OR ITS SERVERS ARE FREE OF VIRUSES OR OTHER HARMFUL ELEMENTS. WE DO NOT WARRANT THE ACCURACY, COMPLETENESS, LEGALITY, RELIABILITY, OR TIMELINESS OF ANY USER CONTENT OR ANY OTHER USER'S IDENTITY, INTENTIONS, REPRESENTATIONS, OR CONDUCT. YOUR USE OF THE SERVICE IS ENTIRELY AT YOUR OWN RISK.

15. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL KAIROX, ITS PARENT, AFFILIATES, OFFICERS, DIRECTORS, EMPLOYEES, AGENTS, LICENSORS, OR SUPPLIERS BE LIABLE TO YOU OR ANY THIRD PARTY FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, PUNITIVE, OR AGGRAVATED DAMAGES, OR ANY LOSS OF PROFITS, REVENUE, DATA, GOODWILL, BUSINESS OPPORTUNITY, OR OTHER INTANGIBLE OR ECONOMIC LOSS, ARISING OUT OF OR RELATED TO YOUR ACCESS TO, USE OF, OR INABILITY TO USE THE SERVICE, REGARDLESS OF THE LEGAL THEORY ASSERTED (INCLUDING CONTRACT, TORT, NEGLIGENCE, STRICT LIABILITY, STATUTE, OR OTHERWISE), AND EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. IN NO EVENT SHALL OUR TOTAL AGGREGATE LIABILITY TO YOU FOR ALL CLAIMS ARISING OUT OF OR RELATING TO THE SERVICE OR THESE TERMS EXCEED THE GREATER OF (A) THE TOTAL AMOUNT YOU ACTUALLY PAID US IN THE TWELVE (12) MONTHS IMMEDIATELY PRECEDING THE EVENT GIVING RISE TO THE CLAIM, OR (B) TEN U.S. DOLLARS (US$10). WHERE APPLICABLE LAW DOES NOT PERMIT THE TOTAL EXCLUSION OF LIABILITY, OUR LIABILITY IS LIMITED TO THE MINIMUM AMOUNT PERMITTED BY SUCH LAW.

16. Indemnification

You agree to fully defend, indemnify, and hold harmless KairoX and its parent, affiliates, officers, directors, employees, contractors, agents, licensors, and successors from and against any and all claims, liabilities, losses, damages, judgments, penalties, fines, costs, and expenses (including reasonable legal fees) arising out of or in any way connected with: (a) your access to or use of the Service; (b) your User Content; (c) your breach of these Terms or any representation or warranty made herein; (d) your violation of any applicable law, regulation, or third-party right; or (e) your online or offline interactions with any other user of the Service.

17. Dispute Resolution; Binding Arbitration; Class Action Waiver

Any dispute, claim, or controversy arising out of or relating to these Terms, the Service, or your use thereof — including disputes about the existence, validity, interpretation, breach, or termination of these Terms — shall be finally and exclusively resolved by binding individual arbitration administered in Sri Lanka, under rules determined by KairoX in its sole discretion, and conducted in the English language. The arbitration shall be seated in Colombo, Sri Lanka. The arbitral award shall be final and binding and may be enforced in any court of competent jurisdiction worldwide. YOU AND KAIROX EACH IRREVOCABLY WAIVE ANY RIGHT TO A JURY TRIAL, A BENCH TRIAL, AND TO PARTICIPATE IN OR INITIATE ANY CLASS ACTION, COLLECTIVE ACTION, CLASS ARBITRATION, CONSOLIDATED PROCEEDING, OR REPRESENTATIVE PROCEEDING. Each party shall bear its own costs of arbitration, and you waive any right to recover attorneys' fees from KairoX except where expressly required by non-waivable mandatory law. Notwithstanding the foregoing, KairoX may seek urgent injunctive or other equitable relief in any court of competent jurisdiction to protect its intellectual property or confidential information.

You may opt out of this arbitration agreement solely by emailing kairoxsolutions@gmail.com with your full name and registered account email and a clear written statement of opt-out within 30 days of first accepting these Terms. Opting out does not affect any other provision of these Terms.

18. Governing Law and Jurisdiction

These Terms and any dispute arising hereunder are governed by and construed in accordance with the laws of Sri Lanka, without regard to its conflict-of-laws principles. Subject to the arbitration clause above, you irrevocably submit to the exclusive jurisdiction of the courts of Colombo, Sri Lanka for any matter that may lawfully be brought before a court. If you access the Service from outside Sri Lanka, you do so voluntarily and are responsible for compliance with applicable local laws. The United Nations Convention on Contracts for the International Sale of Goods does not apply.

19. Changes to These Terms

We may modify these Terms at any time and in our sole discretion. We will endeavour to provide notice of material changes through the App or by other reasonable means, but we are not obligated to do so. Your continued use of the Service after updated Terms are posted constitutes your irrevocable acceptance of the revised Terms. If you do not agree to any revised Terms, you must immediately stop using the Service and delete your account.

20. Miscellaneous

These Terms, together with our Privacy Policy, Community Guidelines, and Safety Guidelines, constitute the entire agreement between you and KairoX with respect to the Service and supersede all prior agreements, representations, or understandings. If any provision is held invalid or unenforceable by a court or arbitrator of competent jurisdiction, that provision shall be modified to the minimum extent necessary to make it enforceable, and all other provisions shall remain in full force and effect. Our failure to enforce any right or provision at any time is not a waiver of that right or provision. You may not assign or transfer these Terms or any rights hereunder without our prior written consent; any purported assignment without consent is void. We may assign these Terms freely and without restriction, including in connection with a merger, acquisition, financing, or sale of all or substantially all of our assets.
